The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant, aged 31 yrs, resides at the above mentioned address since 1 year with her father Shri. Danji Mitha Vaghela age 58 years, mother Hina age 57 years, brother Vinod Danji Vaghela, age 34. The Complainant’s brother is working as a sweeper in Mumbai Municipal Corporation , the family is supported by the income earned from it.
The Complainant received marriage offer from Mr Jeetu Jagjivan Maru, Age 31 Years, having permanent address at Room No A/24. Ramdev Nagar, J. R. Boricha Marg, Opposite Kasturba Hospital, Mumbai-16, Present Address is Room No. 1407, 14th floor, C Wing, Shramik Ekta Federation, J. R. Boricha Marg, Jacob Circle, Mumbai 11 . The offer was received through Lakha Solankhi (neighbor) in July 2011 , who also informed the complainant’s family that Mr Jeetu is divorced.
On 29/11/2011, the complainant married Shri Jitu Jagjeevan Maru in Hindu Meghwad marriage style at Ramdev Mandir, Ramdev Nagar, J. R. Boricha Marg, Mumbai 11. On the occasion of her marriage her father gifted the complainant 4 silver rings of 5 grams, 1 gold necklace of 3.5 grams, 2 gold rings of 3 grams, 3 gold nose rings of 5 grams, 4 pairs of gold earrings of 5 grams each, and 1 double bed, 1 fridge, 1 washing machine. After marriage the complainant was supposed to live together with 5 members namely her husband, mother in law and Nanand Jyoti. The Complainant also had two other Nanandas, who was married, one of them Mrs Meena Mukesh Baria was staying with her in- laws near their chawl and other Mrs Manisha was married to Nilesh Rathod of Surat , but she used to stay at her parents house all the time. Mr. Lakha Vijal Solankhi told my family all the facts about Jitu’s first marriage. Mr Jitu assured the complainant’s family that he would treat me properly. The Complainant found out that she is pregnant in January 2012 after three months of my marriage. Then the complainant told this matter to her father-in-law.
After that the complainant’s Nanand Jyoti and Meena, her mother in law Aloo Jagjivan Maru, started taunting her on everything from housework to food prepared by her. When the complainant told her husband but he ignored. In february 2012 the complainant came to know that her husband, mother- in- law, Nanand Manisha went to Gujrat to see a bride for her husband. When the complainant asked her mother- in- law about this, her mother-in-law refused to talk and then her husband beat me with his hand.
After this incident, her husband used to drink alcohol and beat her, and her mother- in- law and Nananda Manisha, Jyoti and Meena used to abused her frequently and threatened to send her father’s home forever. Due to these issues the complainant was under constant mental stress thus miscarried her unborn baby in the sixth month i.e. June 2012. The Complainant was admitted to Nair Hospital, Agripada, Byculla, Mumbai for treatment. The Complainant got pregnant again in August 2012, but still her husband and mother- in- law were beating her for minor reasons. In November 2012, when the Complainant turned on her husband’s mobile phone, she saw his Facebook chat messages with other women and when she asked it to her husband, he beat her again. The Complainant had given birth to a son in April 2013, after that she went to her parents house for a month, at that time her husband used to come home drunk and abuse her and her parents. The Complainant’s in- laws kept abusing her and used to take her baby away from her. In December 2014, the Complainant was fed up with the quarrel in the house, so she came to stay at her parents’ home . After returning back to in laws house, her three Nanandas were constantly abusing her (her father-in-law had passed away during the period ). The Complainant had given birth to a baby girl in October 2015 , her in- laws was not happy with that, therefore even after the doctors advised her to rest, her in- laws made her do all the household chores from the second day onwards. And her mother- in- law used to harass her along with Nanand Jyoti and Manisha.
The complainant’s Mother- in- law was constantly threatening her, that she will try to marry her husband for the third time with other girl. In August 2015, When the Complainant went to Chinchpokli railway station to collect my household goods, she saw her husband and some unknown woman traveling in a train. When her husband came home, she asked him about this, he beat her so badly that blood started coming from her left ear. Even though she talked about going to the doctor for treatment, she was not taken for treatment. After five days, she herself started suffering excruciating pain and went with her father to Nair Hospital, Agripada for treatment. The complainant many times suspected about her husband’s affair with other women and whenever she asked about this at home, her mother- in- law and meena scolded her. In May 2019, the complainant’s husband used to harass her for bringing money from her parents, and if she didn’t agree for bringing him money, her husband started threatening her with suicide. After that, tired of this trouble and afraid of husband’s threats, the complainant told this to her brother Vinod, who sent Rs 1,40,000/- from his bank account to her husband’s bank account .
In March 2021, as the complainant and her mother- in- law were fighting about her husband’s affair. They started harassing her by spreading false rumors about her affair with her husband’s friend Mr Nitin Baria and installed cameras in the house to keep an eye on her. They had a big fight again as the complainant did not allow to put cameras in her bedroom. Due to this, she was under a lot of stress , thus ate 19 sleeping pills which her mother-in-law was taking. After that the complainant gone unconscious and when she regained consciousness, she was admitted to Wockhard Hospital, Agripada. On coming to senses the complainant realized that she was admitted to Nair Hospital from where she was transferred to Wockhard Hospital and the documents of Nair’s treatment are with her husband. After she was discharged, her husband took both her children and her in- laws asked her to stay for two days but no one came to take her back. After few days the complainant got a call from N M Joshi rd police station, thus she went to answer there. Even after few days had passed her husband refused to take her home. After that she tried to visit her in- laws many times but whenever she went there her mother- in- law and her husband beat her up and threw her out of the house under the threat of police. On May 2021, when the complainant went to her husband’s house to get her documents and see her children, her husband abused & threatened her.

The complainant even held community meetings to save her married life, also tried at Sakhi one stop center, KM Hospital, but her husband did not come for consultation. After that she went to Protection Officer, District Women and Child Department Office, Worli. From there she was advised to file a case under Protection of Women from Domestic Violence Act 2005. Accordingly, The complainant have filed a case against the husband on 19th March 2022. The complainant , in her explanation told that in September 2021, she got a call from her relatives from her native village of Gujarat that her husband married another woman before our divorce. The complainant was shocked and her mental health deteriorated when her husband sent the divorce papers to her in November 2021. Therefore she went to the Prevention of Atrocities against Women department, where her husband did not come for counseling.
The complainant thus have a legal complaint, cause since her marriage, her husband used to insult and abuse her along with her mother-in-law, Nanands and beat her from time to time and asked her to demand jewelry and money from her parents because of her husband’s affair with other women he kept neglecting her, also they kept both her children close to themselves and kicked her out. The complainant produced marriage certificate and marriage registration certificate, wedding photos, as well as above mentioned medical documents.
Police Registered the case and took up the investigation The case is being investigated by the Police officer namely Mr. Yogendra Pache.
The Complainant’s statement was recorded in Marathi ( gave copy of the same to him) and it was explained to him in Hindi and he confirmed the same.
