                2 ) Mohd Afzal Mohd Arif shaikh, Age 26 Years, Profession- labour,  R/o   rehmat                 nagar, gajajan Bldg, Gala-03, nalasopara, Mumbai-11

The gist of the Complaint : Translated from Marathi to English on best effort basis.

The Complainant (Nayak id-081632), aged 40, resides at the above mentioned address with his family, who joined Mumbai Police department in 2008, and is presently serving in Anti Narcotics dept Worli Unit, since 2018.     

I appeared at the central regional dept, Mumbai for duty on June 10, 2022

By the order of superiors, to take search and act against the drug addicts in the police station area, the Complainant along with Hawaldar 970649/Salunkhe, Hawaldar 33840/Jadhav, Nayak 03-1246/Dalvi left with the materials required for the Panchnama at 17:40 hrs.. While patrolling , at 18:20 hrs. patrolling staff suspected two person are consuming narcotic drug- Ganja beside wall, as they were smoking something by rubbing & stuffing certain thing frequently in his chillam at  YMCA ground,  near BMC gym , Mumbai-08,.

After that, API Mohite asked the complainant to go and get two PANCH . After that, the complainant came with two PANCH in a short time. Police Sub-Inspector introduced both the PANCH to our police team and explained the purpose of calling the them to the said place, the PANCH agreed to appear as judges.

After keeping watch on him for some time, complainant ordered to surround him & take him into custody. Accordingly squad officers detained him, they found lighted Chillam with Ganja. After that, API Mohite identified himself, the Pancha and the police team to the accused and asked him to allow to search him, but they refused.

Then, complainant asked accused about their whereabouts and what they were doing at that place, and they said that they were consuming ganja, a narcotic substance, by stuffing it into a chillam. Then he was asked his name and address, They gave name as Ashfaq Mohd. Naushad Khan, Age 32 Years and Mohd Afzal Mohd Arif shaikh, Age 26 Years address as above.

Accused persons eyes appeared swollen and red due to drug consumption and his mouth smelled rough. Immediately, the accused was searched before the Pancha, 1) a Chilim 2) a dirty white cloth, 3) matchbox in his hand was seized, extinguished and destroyed on the spot. The accused were medically examined at JJ hospital where it was confirmed to have consumed narcotics. It was explained in Hindi to the accused that if there is any complaint against the search, he will be produced before the nearest Magistrate and Gazetted Officer, to which he refused. And then the accused was taken in custody after explaining Bail provisions & reasons for arrest and taken to police station for further interrogation.

Police Registered the case and took up the investigation The case is being investigated by the Police  officer namely Mr. Yogendra Pache.

The Complainant’s statement was recorded in Marathi and it was explained to him in Hindi  and he confirmed the same.
