The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant, aged 35 yrs, resides alone at the above mentioned address since 2018, presently living with wife Shajia Lakhani age 31 years, daughter Aja Lakhani age-1 years, mother Naseem Lakhani age-66 years. The Complainant is working as a Store Manager at Forest Sales Company Opposite Mahalakshmi Mandir, Tirupati Apartment, Bhulabai Desai Road Mumbai for the past five years, the income earned from that supports the family livelihood .
The Complainant’s mother has savings account with DCB Bank, bearing account number 00311100043944. Since the complainant wanted to buy a new house, from the past few days, he was looking at the advertisement posted on OLX website. On 26/04/2022 the complainant had seen an advertisement of a flat for sale on such site. As per the advertisement, flat for sale is of D.S. Builders that it is located near Arihant Heights, Byculla West Mumbai, opposite byculla station. The complainant went to the said site and messaged that he was interested in buying a said flat. Then on the same day he got a call on his above mobile number 8237965029 and the lady speaking said she was speaking from DS Builder , and further said that recently you showed interest in our advertised property on OLX and messaged us for the details, after that the said woman asked to contact a person named Raj and gave his mobile number 8149299338. After that, when the complainant contacted him on such mobile number, to which Raj (the contacted person) requested him to meet at Byculla (West) Masjid. After that, the complainant went to the said place around 04.30 pm, called Raj, who found to be already standing at such place . Raj (the contacted person) introduced him with two other namely Aditya Pandit and Shekhar as D.S. builder’s men. Then the three of them showed the complainant a total of four to five flats in the nearby under- construction tower Arihant Heights. Among them, the complainant liked flat number 1601 , who then said that he will bring the family in his next visit to show them the said flat. Then on 29/04/2022 the complainant’s wife, mother saw the said flat No. 1601 and they also liked it.
The complainant accordingly asked Mr Raj for the next meeting to finalise the deal and about the token, to which Raj asked him to come at their Borivali office at office number 124, First floor, Yashwant Shopping Centre, Opposite Borivali Station, Borivali East Mumbai , and sent address of the office on WhatsApp. Then on next day on 18/05/2022 the complainant, his wife, his mother went to said office at Borivali. At that time Raj, Shekhar were present in the office, after negotiations, the transaction of the said room was settled at a total price of 85,00000/- for flat no.1601, Arihant Tower, Near Byculla Station, Byculla (West) Mumbai. Accordingly the complainant gave Two cheques , one of Rs.1,50,000/- and the other for Rs.13,00000/- totaling Rs.14,50000/- issued in the name of Mr. Bhawani Construction. The token amount was given from his mother’s account in DCB bank and thus on 24/05/2022 total of Rs.14,50000/- was deducted from the said account. Then on 26/05/2022, Raj sent a receipt of the above payment via WhatsApp to the complainant’s mobile number from his mobile number. On 28/05/2022, the complainant contacted Raj on his mobile and asked when to do the registration of flat transaction, Raj told the complainant that minimum 60 percent amount of the transaction is to be paid and then only registration will be done . On 29/05/2022. accordingly the complainant gave Two cheques of Rs.15,00,000/- each totaling Rs.30,00,000/- from his mother’s account in DCB bank , issued in the name of Mr. Bhawani Construction to Raj. Both the said cheque cleared on 02/06/2022 and a total of 30,00000/- was deducted said DCB account. Then Raj WhatsApped up the complainant some more documents regarding construction and draft of MOU for flat transfer.
On 08/06/2022 the complainant’s mother Naseem Lakhani received a call from Assistant Police Inspector Mr Kishor Mane of Nalasopara Police Station , who informed that Rs.30,00,000/- was paid from your account to person named Ashish on 02/06/2022 , that said person and his friend are fraudulent, they are in the police custody of Nalasopara Police Station, Mira Bhayander Police Commissionerate, and a case has been registered against them in the local police station, thus the statement of the complainant’s mother was required to be recorded against such transaction. the complainant’s mother informed police that they dealt with person named as Raj not Ashish, and had paid the amount to buy a flat in above described Byculla flat. Thereafter the complainant and his mother went to Nalasopara Police Station. The Police Inspector informed them with photo that Mr raj actual name is dinesh bishnoi and of Mr Shehar actual name is Ashish Singh, both are fraud on whom already some criminal complaints have been registered and their Bank account has been sealed.
The Complainant convinced that he and his mother have been deceived for transferring ownership of flat above described Byculla flat, therefore have come to the police station to file a complaint against said unknown accused who deceived her & took the amount.

Police Registered the case and took up the investigation The case is being investigated by the Police officer namely Mr. Yogendra Pache.
The Complainant’s statement was recorded in Marathi ( gave copy of the same to him) and it was explained to him in Hindi and he confirmed the same.
