The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant, aged 26yrs, resides at the above mentioned address since 2013. The Complainant is working as Cook at Dhobi Ghat, Mumbai, Out of such income, livelihood is earned.
The Complainant was living alone since 2013 at such address, and is native of Darbhanga District, Village Bharwada, Post- Tehsil- Koti, State of Bihar. The Complainant have done no education, can only be write name in Urdu, apart from that she cannot read and write. The Complainant’s mother passed away when she was 3 years old after that her father got married again. Since hare father was not taking care of her, her grandmother took her to Milukpur village. While the complainant was staying with her grandmother, she was being harassed by her maternal uncle and other people in the house, therefore she left such home and came to Mumbai without informing anyone . The Complainant knew no one in Mumbai but somehow got servant job at spme business men office ( whose name she don’t know) , on the third floor Navlatch Building, near Maratha Mandir Talkies, where she worked for 5-6 months, then she did housework with person named Anwar Sheth at Dudhwala Compound, Mumbai Central , and After working with Anwarji for about 2 years , she went to work in Bag factory at Dhobi ghat, where she used to prepare food for workers in factory. The Complainant at the age of 16 yrs, met person named as Colonel Sheikh who worked in a factory and got married to him in a mosque in Saat rasta , who took her to village Ruksol, Beria, Nepal . The Complainant had given birth to a daughter with Colonel Sheikh, named Shahnaz. When the complainant’s daughter was one and a half years old, she left Colonel Sheikh from Nepal and came back to Mumbai and worked at Dhobi ghat. The Complainant was staying with her girl on the footpath at jhula Maidan and as the boys of that Maidan were harassing her and her daughter, she rented a house at Ghulam Manzil . As no one was giving her work, the complainant started a business of selling Cigarettes, Gutkha, peanuts at Dhobighat.
At that time person named Mumtaz Khan, while on carrying business kept a constant watch on her, and later started dating her. When the complainant asked him to marry her after they established mutual relationship, Mumtaz said that as she is already married and thus they need to get married secretly without telling his family, and promised that he would tell his family after his marriage. On 23/01/2022, the complainant was taken to the mosque at Hindustan Masjid at Byculla Station, her acquaintance Mujibur Rahman from the place where she was staying on rent, was taken as a witness. At that time, Mumtaz did not bring any witnesses and no one from his family attended. After getting married , mumtaj also came to stay with her in her rented room. before the month of Ramadan, Mumtaz gave her some coconut water due to which she started vomiting and fell asleep, thus she slept in the house. the next day she woke up with a headache so she went to Nagori Clinic for treatment. the complainant’s husband suspected that she was pregnant so he gave her some kind of coconut water pill to induce abortion. At that time Mumtaz’s mobile phone was kept with her on which she got a call from Mumtaz’s sister, to whom the complainant informed that she is the wife of Mumtaz , then Mumtaz’s sister told her that Mumtaz is already married with other girl and has two children, and his wife is living in the village of U.P. . the complainant then inquired about Mumtaz, and acme to know that she was given abortion medicine on the advice of Mumtaz’s younger brother Name Arshad. Thereafter the complainant used to have arguments about the fact that Mumtaz being already married, on which Mumtaz started beating her and her daughter.
About 3 months ago the complainant visited Mumtaz’s native village Udaipur Bhura, Chaiki Mirzapur, Dist. Shahjahanpur, Uttar Pradesh, at that time the Mumtaz and his family beat her up a lot and forced her to run away from there, after that Mumtaz stopped visiting her house in Mumbai.
The complainant tried filing a complaint against Mumtaz as she convinced that Mumtaz arranged a marriage to cheat her and started taking money from her for the expenses, and thus whenever she did not pay him for his expenses he used to beat her. The complainant tried filing complaint against him 10-12 times before but no one was listening to her complaint, then she listened to YouTube conversation of Advocate Shabnam Shaikh, in mobile and accordingly went to Bandra to contact Shabnam Shaikh Help Care Foundation, (Mobile No. 9819797564) who gave her a complaint on her letterhead dated 31/05/2022.
The complainant thus have a legal complaint against her husband Mumtaz , who Married her by deception and took her 5 gram gold earring and a 10 gram gold chain from her neck and fled to the village. Also, against Mumtaz’s brother Arshad and father- in- law Sagir who threatened and beat her up. Also against Mumtaz for tortures made physically and mentally on her.
Police Registered the case and took up the investigation The case is being investigated by the Police officer namely Mr. Yogendra Pache.
The Complainant’s statement was recorded in Marathi ( gave copy of the same to him) and it was explained to him in Hindi and he confirmed the same.
