The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant, aged 25 yrs, resides at the above mentioned address since the 1 yrs with her parents and siblings. The Complainant’s B.com graduate from Behramji Jijibhoy Parshi Institute, Charni Road. After completing my education in 2018, she joined as HR manager in M. Gheewala Global – Consultant , at Haji Ali, Mumbai in 2019 ,to earn livelihood from it.
The accused, Huzel Ahmed Sheikh was also working as a client representative (event co-ordinator) in the said company. Since he and the Complainant were from the same caste, they became friends and later friendship turned into love, therefore they thought of getting married with the consent of their parents and accordingly the date was fixed by both the families. On 07/06/2020, Nikah was performed at the Complainant’s home as it was lockdown. Nikah Qazi Name Abdul Jabbar Khan, resident of 179 , Wazir Building, 3rd floor, Bhendi bazaar, Mumbai Phone no. 23455420/23456139 . At the time of Nikahnama the Complainant received Rs.11,000/- mehar amount from groom’s family. At that time the husband Huzel Ahmed Sheikh were given Rs.50,000/- in cash by Complainant’s family with 20 gram gold ornaments consisting of 15 gram gold chain and 5grm ring , also Silver ring and a titan watch was given. The Complainant was also given gold rings, 5grm gold chain, and an Italian set consisting of a necklace, 2 ear rings, a ring in gold.
After that, the next day, the complainant went to the in-laws house, where Valima Program was held. In June 2020, at the end of the month, her husband Hujel took away her mobile phone on the grounds that the Complainant was receiving lot of calls from her home. and then by asking “why are there pictures of friends in Complainant’s mobile phone? her husband Hujel slapped her on cheek and formatted her mobile handset. After that the complainant’s mother in law taunted her regularly that she can’t even make it with cooking.
For this reason they used to taunt her and harass her mentally and they used to accuse her of not bringing valuable materials from her house. The Complainant’s mother in law told her husband to call the complainant’s mother and ask her to get a new motor cycle , after which Hujel asked her father to get a new motor cycle for both newly wed.
when the complainant realized that she was pregnant, wanted to do sonography, her mother- in- law told her that she would not get any money for doing the sonography. Also, the complainant was not given a single penny for any medical examination and other medical expenses. The complainant used to get money from her parents for medical tests and other treatments. In October 2020 when the complainant was 5 months pregnant her parents came along with Hujeel’s mother Name Sadaf Shaikh and brother in law Mujammil for Kashmir tour. The next morning after they came back from Kashmir to Mumbai, the complainant woke up from sleep and realized her husband Hujel was cutting her hair from head and when she objected and told her mother-in-law about it. At that time, her mother- in- law instead teased her by saying “why did he cut your hair partially, Hujail should have done a full bob cut”. At that time, Hujel told the complainant that cutting her hair was the first punishment. After this, three more punishments are left.
Because of this, the complainant’s parents took her to their home again in the first week of November-2020 as she was mentally disturbed. Hujel did not call her back to his house after that, nor did Hujel’s family. Meanwhile on March 03’ 2021 the complainant was admitted to Tolkawala Hospital for delivery and gave birth to a baby girl. At that time, her family told Hujeel and mother- in- law that she had a daughter, who then came to the hospital to see her but no one spoke about taking her back to in laws house. After her daughter was 3 months old, and no one was taking her back, the complainant had herself gone to Hujel’s house. This time 2-3 months passed without difficulty but none of the in- laws paid for her daughter’s milk and toys and other expenses. the complainant used to spend her daily expenses by bringing money from her mother. the complainan’s husband always used to abuse her for using mobile phone and was never giving any money for expenses, he also used to beat her up for minor things.
The complainant used to tell it to her mother in law , who used take side of her son and also used to advise Hujel to get married again and that he would get children from another wife. The complainant’s mother in law used to always tell her that, divorce Hujel on your own, after that she could marry Hujel again. The complainant’s mother in law used to claim that they have not received money and jewelry from complainant’s family . Also asked her to get a Mo/Scooter Activa for her husband and money for a new house. During Bakri Eid 2021 when complainant’s daughter Hamna was sick , at that time Hujeel and her mother- in- law did not gave money for treatment. At that time, complainant brought her mother’s money and took daughter Hamna to Dholkawala hospital.
The complainant became pregnant again for the second time. At that time, her mother- in- law and Hujel told her to go at Dr. Shabana clinic in Dongri and Dr. Shabana Yani was given some pills to eat , to induce abortion. Then her mother- in- law went to Lucknow for 15 days around October 2021. At that time there were four people at home, complainant, her husband and her Brother in law Muzammil and daughter Hamna. One day when she washed her husband’s cloth mask with shampoo, Muzammil told her husband about this matter, then her husband dragged her from the floor of the house, shouted on her and beat her for using shampoo to wash clothes. After that, even when baby was in the house, her husband sprayed red Kashmiri chillies in the house which would cause trouble to baby. The next day her daughter was playing and Hujel was sleeping. and 09.00 am. Huzel went to work. and 11.30 am. She put Hamna in his walker and went to the garden to put clothes on. At that time Muzammil picked up her daughter with a walker and locked her in the outer gallery , who was crying their. At that time The complainant came down from the garden and went to the gallery through a small hole and took Hamna into the house. When she told this matter to her husband Hujeel, Hujeel turned a blind eye. The Muzammil turned AC chilled mode , even though her daughter was having cold, Muzammil used to do things that will cause troubles to the complainant. Her husband did not said a single word to Muzammil when he pulled her dupatta and dragged her by the hand into house. Also, mother- in- law used to abuse her and her family in very dirty words
Even so, they used to express doubts about her behavior and told all the relatives that if they get some photos or some proofs of her college days, they should inform them. Still, mother- in- law, was asking her to give talaq voluntarily, then her mother- in- law would threaten her about giving talaq three times in three months, once every month, as per Sharia law
Then after she got pregnant for the second time, they went to Dr. Joshi at N M Joshi Marg. Who had given with the name of abortion pills. At that time, Hujel hid the abortion pills from her, then she herself got the second pills from the medical and got the abortion for the second time through Dr. Imran of Harish Nursing Home, Chinchpokali under anesthesia. At that time, Hujel brought her to parents house and told her to rest for 15 days. As Hujel had broken the mobile into pieces out of anger that she was using, her father gave her a simple mobile handset of Jio company, on which he abused her parents and threatened them, for not to give me a mobile phone in the future. After the complainant stayed at her parent’s house for about 15 days , she tried calling Hujel to take her back but he was not picking up her call , hence he sent him an SMS but Hunjel didn’t gave any response then . the complainant thus filed a complaint against Hujel in Agripada police station. . At that time, Hujel had also filed a police complaint against her. Accordingly , a compromise was made between them under Saturday’s grievance redressal system through the senior officials of Agripada police station. But even after that settlement, her husband was not living well with her and was always harassing her by finding excuses. While the complainant currently living with her parents, her husband and father- in- law does not gave back stridhan as detailed above , even on demand.
The Complainant thus have legal complaint against her husband , and in-laws for repeatedly insulting and beating her, for not taking care of her/ her daughter , leaving her, demanding money & threatened her with divorce, and for treating her with mental distress.
Police Registered the case and took up the investigation The case is being investigated by the Police officer namely Mr. Yogendra Pache.
The Complainant’s statement was recorded in Marathi ( gave copy of the same to him) and it was explained to him in Hindi and he confirmed the same.
