The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant, aged 27 yrs, resides at the above mentioned address since the age of 12 years The Complainant is crippled with her right leg since birth . The Complainant used to live in Saat rasta with her mother but as they both are not in good terms with each other, presently she was staying at her village friend Jasmin’s house at the above mentioned address. The said house belongs to Bilal Khan, the nephew of her friend Jasmin. The Complainant is doing embroidery work in Madanpura, Nagpada, Mumbai , earn livelihood from it.
The accused Nizamuddin Mohammad Idris used to come on duty to meet his friends in the area where the Complainant lived. At that time she met Nizamuddin. Nizamuddin told her that he originally lives in Uttar Pradesh and owns a Bhelpuri business in Kurla. Gradually their conversation increased and they exchanged mobile numbers. They always used to talk on mobile. Whenever Nizamuddin came to meet his friends at such place, she used to meet with him. After that they became good friends. Between 2013 and 2019, they were meeting continuously. In 2019 Nizamuddin invited the Complainant to meet him at Sahara Hotel Kurla, they had physical relations at such place. Nizamuddin then promised to marry the Complainant, but was refusing to marry under the pressure of his family. The Complainant thus filed an application against him at Agripada Police Station. Accordingly, he was called to Agripada Police Station.
After that his family and the Complainant’s family gave permission for marriage and then they got married on 17/12/2020 in the presence of people from both the families. After marriage they moved to Kismat Nagar Takdeer Majjid CST Road Kurla East. Nizamuddin and Complainant were living on rent in Kurla. The Complainant was paying the rent of the said house from her salary. The remaining salary was given to Nizamuddin. Nizamuddin’s brothers- in- law Kallu, Qurban and Dilbahar were working at Hotel Silk Paratha in Kurla so they used to come at their house for lunch daily.
Nizamuddin and the Complainant were constantly having petty arguments so they stopped coming home , and because Nizamuddin was addicted to alcohol he used to beat her with his hand. the Complainant therefore filed complaint at police station , where he was summoned and given an understanding.
After that they were living together, again after some days on 02/06/2022 Nizamuddin went to his village Hakim, Uttar Pradesh saying that he will come back after Muharram. Nizamuddin instead sent her letter dated 20/06/2022 asking her to come to his village but as she was alone for packing all the stuff at Kurla she did not go. On 19/03/2022 the Complainant received a call from her mother- in- law and Nanad Saviya saying that you , the Complainant should come and bear own expenses for travel, otherwise she will not be given a bed after coming there . Even after that, Nizamuddin called her and abused her on the phone and asked her about money to buy a car. The Complainant told him that she didn’t have money, but he kept asking her repeatedly to bring the money or else threatened for consequences . A total of 8,00,000/- (Rupees) has been taken till date. After that Complainant came to know that Nizamuddin has married again without telling her with the help of his family
The Complainant thus have legal complaint against her husband , and in-laws for repeatedly insulting and beating her, for not taking care of her and leaving her, demanding money & threatened her with divorce, treated her with mental distress.
Police Registered the case and took up the investigation The case is being investigated by the Police officer namely Mr. Yogendra Pache.
The Complainant’s statement was recorded in Marathi ( gave copy of the same to him) and it was explained to him in Hindi and he confirmed the same.
