The gist of the Complaint : Translated from Marathi to English on best effort basis.
The Complainant, aged 50yrs, resides alone at the above mentioned address since a month, used to stay at Room No. 22, Fifth Floor, Mahalakshmi Sadan, Saat Rasta Circle, Byculla (W), Mumbai. At Byculla area, the complainant bought gold from their acquaintance Ritesh Sanghvi and Dipesh Sanghvi at Sanghvi Jewelers, Shop No. 01, Mahatma Cottage, Beside Mahakali Temple, Opposite Kasturba Hospital, Sane Guruji Marg, Mumbai 11. She used to buy from their father K Pravinchand Sanghvi . On 13/11/2021 she gave used 50.02 gram (05 tola) gold mangalsutra was given to the said Jewelers shop for converting mangalsutra in to a new design. At that time Ritesh Sanghvi and his brother Dipesh Sanghvi were present in the shop and took a legal receipt for it. The said receipt number is 137. At that time Mr. Ritesh agreed to give delivery on 27/11/2021. After that, when the complainant went to get the mangalsutra on 27/11/2021, she was told that the mangalsutra was not ready and it would take 08 to 15 days.
After that, the complainant repeatedly went to the said shop but they started giving her vague answers. After that, Mr. Ritesh’s Mob No 98691390791 and Mr. Dipesh Sanghvi’s Mo. No 7304545785 were contacted and inquired about the Mangalsutra, and they gave mixed answers. Then on April 2022, they told the complainant that his father had passed away And Mangalsutra will be ready in the next one month
As they didn’t make her mangalsutra , she complained , and thus sanghvi jewelers both brothers told her that they will refund money for mangalsutra. On 22/07/22 they came at her home and gave HDFC. Bank Account No. 50200060885552, NM Joshi Marg Branch issued a cheque of Rs.1,00,000/- bearing number 000037 dated 25/07/22 and said to pay the remaining amount in the month of August 2022.
on 26/07/2022 cheque was deposited in the complainant’s Bank of Maharashtra, Account No. 04000701022014. But same is cleared for insufficient fund . So when she called Ritesh and inquired about the matter, he hung up the phone saying that he don’t know anything about it and will ask his brother Dinesh. After that the complainant kept calling and asking about it. As on 02/08/20022 Ritesh said that now they have balance in said Bank account. and asked to deposit the same cheque in the bank. the complainant deposited the same check again on 03/08/5022 in Bank , again it bounced back, it was told that the amount is not available . At that time, the complainant called ritesh back and asked him about the matter, he said EMI of his house has deducted from the bank account hence same has happened. Likewise 09 to 10 months passed, ritesh Sanghvi and Dipesh Sanghvi did not return Mangalsutra or give money in return. On 23/08/2022, the complainant went to the shop of said Jewelers along with her husband, son and daughter- in- law, and the said shop was found closed. When the complainant went to the nearby shop and checked, it was found that the said shop has been closed since last one month. Therefore the complainant was convinced that she was defrauded and taken her valuables .

The Complainant’s statement was recorded in Marathi ( gave copy of the same to him) and it was explained to him in Hindi and he confirmed the same.
