The gist of the Complaint: Translated from Marathi to English on best effort basis.
The Complainant, aged 38, resides at the above-mentioned address, who joined the Mumbai Police department in the year 2000, and is presently serving at Samata Nagar Police Station since 2017 (Hawaldar No-00257/Samtanagar station ), Currently working in Anti- Terrorism Squad.
The Complainant appeared at the police station for Day duty on 16/01/2023 at 9.00 AM. The Complainant along with Inspector Mr. Tanpure, Sepoy 111187/ Supekar went patrolling within the police station area at Terapanth Bhawan, Poisar with the laptop, printer, and other materials in a private vehicle. Where they found Beat Marshal-01 Sepoy 113178 / More patrolling the Police Station Precincts as mentioned above.
While the abovesaid squad was patrolling with the beat marshal at 1.15 pm, near Kala Patthar, Poisar, Thakur Complex, Kandivali East, the accused was standing suspiciously on the side of the rickshaw carrying a white sack. When the squad started approaching the accused, he got scared and tried to run away. At that time the police team caught the accused and asked him why he was trying to run away?, to which the accused showed the carry bag containing packets of Gutka. At that time, Inspector Mr.Tanpure informed the said information to Sr. Inspector Mr. Padwal, who instructed him to take action before the two PANCH (Witness).
At that time Inspector Mr.Tanpure asked the complainant to go and get two PANCH. After that complainant came back with two PANCHA. Inspector Mr. Tanpure requested the said PANCHA to appear as umpires to take action after giving the information as mentioned above, to which PANCHA voluntarily agreed. After that, the accused was asked about his name, occupation, and address, to which he stated the abovementioned details. Then the accused was asked about a white-colored nylon bag in his possession. The accused said the sack belongs to him and it contains SHK company Gutkha( The Gutkha banned by the Government of Maharashtra) . Thereafter said the sack was inspected before both PANCH, in it banned Pan masala and Gutkha of total of Rs. 10260/- were found.
Out of the said stock one packet was seized as a representative sample for chemical analysis and kept in a khaki-colored paper packet which was sealed with a label of PANCHAS and Police assistants and the rest of the material was kept in a white-colored nylon bag, said sack was sealed and the identification labels of the policemen, PANCHAS were affixed.
After that, when the police team asked the accused about the source/person from whom he had taken the Gutka and where he had stored it, to which he gave vague answers. Therefore, to take further action Indrasingh Premsingh Solanki as described above is taken into custody for illegally selling/ storing substances prohibited by the Government of Maharashtra, with sealed GUTKA packets worth Rs. 10260/-. Inspector Mr.Tanpure then completed a detailed PANCHNAMA The Complainant’s statement was recorded in Marathi and also copy of the same was handed over to him and he confirmed the veracity of the same.
