The gist of the Complaint: Translated from Marathi to English on best effort basis.

The Complainant, aged 24, resides at the above-mentioned address, she moved at such place on June 10, 2019, after their marriage to stay with her husband Praful, and mother- in- law Ms. Rekha Sridhar Kharat.

The Complainant like others used to live her parents at Kabaravu, Bachav, District Kutch, Gujarat. The Complainant has four sisters Gita, Shital, Payal and Mamtasha and one brother named Ashok, all her four sisters are married, who are staying in Mumbai with their in-laws.  At Present, the Complainant’s father Balji, mother Ramila, and brother Ashok live in her hometown in Gujarat.

On 26.12.2022, The Complainant was beaten by her husband (the accused) with a stick and a helmet, and therefore out of fear, she moved to her native place in Gujarat at the above-mentioned address. After this, the Complainant has come to the police station along with her father namely Mr. Valji Amba Patel, and sister Ms. Geeta Gandhi to file a complaint against her husband. The Complainant’s father does farming and the income from it supports their household in Gujrat.

The Complainant married the accused on June 10, 2019, at Ganesh Mandir in Bandra Court (love marriage). The accused is a skating coach, who teaches kids in Mira-Bhayander. The Complainant’s mother- in- law and other in laws were present at their wedding,  as  marriage was against the will of her parents,  and no one from her parents’side was present.

After marriage, the Complainant came to live with her husband & in-laws i.e. mother- in- law Rekha, Brother in law Nitin at their above address in June 2019. The Complainant’s Brother-in-law Nitin died in the year 2021 on account of liver failure due to excessive alcohol consumption.

After two months of marriage, the accused started behaving badly, the accused used to come home in a drunken state and used to beat and abuse the Complainant for small and big reasons in their house. The accused used to slap her on the cheek for the smallest reason in the house. Also, the accused used to sexually harass the complainant by having intercourse with her in such a way that she would be sexually harassed.

The accused used to be very angry and violent, and also started demanding Rs. 5 lakhs to start a skating accessories shop. The Complainant told him that it was not possible to pay him because her parents’ financial situation was not that good. The Complainant expressed her desire to get a job for her, the accused stopped her from taking a job to take care of his brother Nitin.

On, November 2019, the Complainant went to Mira road for her husband’s student birthday. at that time her husband’s colleague Santosh Kumar Mishra was also there, after returning home, doubting her character the accused said “why were you looking at him in the party?” and then beat her up with a waist belt and sexually harassed her.

The accused took away the Complainant’s phone and used to lock her in the house while going to work, and often the accused would come home suddenly and make sure whether the complainant had any conversation with anyone.

The Complainant, when told the matter to her father and sister, they requested the accused to allow a phone and not to abuse, but still, there was no change in the accused’s behavior.

After four years of marriage, the complainant had no child, hence the accused used to say doubting her character that she must be taking birth control pills, and then used to torture her. The accused used to yell at the complainant for talking to her four sisters from time to time. 

 The accused, this way, used to give the complainant mental and emotional trouble by arguing and fighting and used to beat her for small reasons. Even though the complainant’s father and sister told him gently not to do all this, he did not change.

On 25.12.2022 the complainant went to her sister Gita Gandhi’s house for Christmas, that day her husband came late drunken state, and on the second day, the accused without listening to her started slapping her on the cheek, with obscene remarks, also tried to give burn her on the face with a hot iron, at that time, in the process of self-defense, complainant’s hand caught hot iron.

Therefore, the Complainant left him and went to her sister Gita’s house as she was afraid of her husband’s violent and cruel behavior, and got treated at herself in Shatabdi Hospital for the injury caused by her husband. And in a couple of days the accused went to her parents’ home.

The accused has threatened the complainant, if she does not come home, he will to go to the house of her sisters living in Mumbai, and will destroy their lives and also kill the complainant.

Accordingly, the complainant have come to file a complaint at the police station.

The Complainant’s statement was recorded in Marathi, and it was explained to her in Hindi, also a copy of the same was handed over to her and she confirmed the same.
