The gist of the Complaint: Translated from Marathi to English on best effort basis.

The Complainant, aged 35, resides at the above-mentioned address since 2019, with her father Deepak Singh, age 65+ years mother Shakuntala Singh, age 61 years, elder brother Rupesh Singh, age 39 years, younger brother Vikash Singh, age 33 years. The Complainant currently working as a teacher at Town High School, Poisar, Kandivali, Mumbai.

The Complainant’s husband Mr. Deepak Indrasen Singh, aged 35 years, R/o Room No. 03, Indrasen Chawl, Besides Ganesh Darshan Apartment, Savarkar Nagar, Vartak Nagar Thane.   The Complainant first met her husband on 12/12/2012 with their family, and in that meeting, the marriage was decided, which is followed by the Tilak ceremony (Engagement Ceremony) at in-laws place.

In the Tilak Ceremony, the date of marriage was fixed on 06/02/2013, for such ceremony Complainant’s father gave Rs. 1,25,000/- to Deepak in cash and clothes to Deepak’s entire family, his sister’s family, overall complainant’s father spent Rs.7 lakhs on the entire event.

Thereafter, the marriage took place on 06/02/2013 at Tera panth Bhawan, Thakur Complex. then the send-off ceremony (vidai) took place as per the custom. When the Complainant was at home, her Sister in law Vandana used to threaten her by leaning on her, saying “Vidai Mai Ate Wakt Jo Jo Saman Bola Hai, lete aana(While coming to house, do bring in all stuff which we had asked).  On 13/05/2013, the Complainant came back to her husband’s place after the vidai event, then the first 10 to 12 days went smoothly with her, later the Complainant realized that everything  said before marriage was a lie

The Complainant came to know that her husband is not doing any job even though he is a B.Com graduate and that her parent-in-laws, sister in law Vandana, Vandana’s husband  Bhanu Pratap, Vandana’s child Sahil and Shweta lives in said house.

After that the Complainant’s husband Deepak, sister in law, Ms. Vandana and her husband Bhanu Pratap started harassing her, they used say “Tumhare Bap Ne Kya Diya Hai Humein? Itna toh chamar siyar bhi dete hain, tere bap ne kya diya hame?” (What your father has given to us, least this is given by lower caste people, what your father has given?) And then they started asking her for money.

The Complainant’s father gave her dowry of Rs.395000 in marriage as follows ;

and all the household items were given but even then, her husband and in-laws were taunting her “Free mai shaadi ho gayi hai, kuch bhi nahi diya hai tere bap ne hame” (Marriage was done for free, your father has not given anything). At that time, her in-laws Madhuri Singh and Manoj Singh came from Thane and started harassing her due to money.

The Complainant decided to get a job as her husband did not have a job, and for medical expenses of father-in-law, despite the opposition of father-in-law. In July 2013 the Complainant got a job as a teacher in Dnyanodaya Vidya Mandir. The Complainant’s husband and nanand (Sister in Law) used to beat her with their hands saying that “mana kiya fir kyu padhane jati hain” (Why you go to teach, when you have been told not to go). At that time her father-in-laws supported her.

The Complainant’s husband used to torture her to bring money from her home, even to complete his B-Pharm degree and taunted her “Tumhare bap ne hamari sab mange puri nahi ki, hai to ab mujhe 3 lakh rupees chahiye, mein degree complete karunga”. (Your father has not complied with all out demands, now I need Rs.3 Lacs, I will complete my degree with that money).  Accordingly, the Complainant’s mother gave her Rs.2,50,000/- which she gave to her husband. After that, her husband got his B- Pharm degree within two years.

The Complainant in- laws i.e. husband, Nanand Ms.Vandana (Sister in Law), Nandoi Mr. Bhanu Pratap (Brother in Law) and Nanand Ms. Madhuri Singh (Sister in Law) as soon as her husband’s graduation started torturing her and used to taunt her about bringing money from father again, they used to beat her with their hands and threatened her, at that time Complainant’s father-in-law rescued her from them and they immediately called Complainant’s father and asked him to take Complainant home.

Tired of her In-law’s daily harrasment, Complainant asked her father to hold a meeting together and request him to stop all this. Accordingly, on 04.04.2017, her father, brother, maternal uncle and uncle came to her house for settlement. But instead of talking, Vandana’s son Sahil threw shoes at Complainant’s uncle and started to beat her with his hands.

The Complainant opened the cupboard to put jewelry as she was going for one marriage ceremony, but she didn’t see any jewelry. When she asked her husband about the jewelry, he beat her and abused her, and took away her mobile phone.

The Complainant’s father-in-law bought a flat in Naigaon in her and her husband’s joint name. After a year her husband gave demanded rupees two lakh fifty thousand rupees for purchasing parking area in Naigaon flat building. For which Two lakh ten thousand rupees have been sent to her husband’s account from Complainant parents side and forty thousand rupees have been paid in cash. But none of that amount was returned.

As Complainant was a teacher, her husband used to beat and abuse her in front of the children who used to take the tuition. Tuition pupils father used to come to her to pay tuition fee while her husband kept suspecting her for that.

On 13/08/2019 Complainant told her husband “ab mujhe ye sab bardash nahi horaha hai, main ab yaha par nahi rahungi aur na hi apni bahno aur jija Ke saath” (Now I cant suffer any more, I cant live here and neither I can live with my sister and her husband) on that her accused husband replied “tujhe jana hai to ja lekin wo naigaon ka flat pura mere naam par karke ja” (If you want to go you go, but transfer the entire Naigaon Flat in my name). As soon as she said no, he beat her and started hitting her hard, that when she said “forgive me, bring the paper, I will give you”,  that’s when my husband left her.

The Complainant then opened the door and ran out of her house. People living in neighborhood came to her rescue. The Complainant then called her father, on next day i.e. on 14/08/2019 her father and her brother came to take her back, then with along with them the Complainant went to police station and lodged a complaint against her husband and returned to her parent’s house at Kandivali.

On 04/10/2019, the Complainant’s husband came to school and said that “my wife has left home and is not talking to me so please ask her to stay with me”. The headmaster called the Complainant, where accused started beating her, then the staff there stopped her husband. After the accused started vandalizing the school property, the school people immediately called the police and handed him over to the police.

The Complainant got fired from job because of the incident at school. The Complainant’s husband had an accident on 03/02/2021 so he was admitted to Titan Hospital Manpada, The Complainant was taking care of him in the hospital for 6 days, as he didn’t have money at that time so she transferred Rs.21500/- to his account and gave him Rs.5000/-.

In June 2022 accused husband came to her parent’s house, shouted “meri biwi hai main leker jaunga tumko kya karna hai” (She is my wife, I will take, what you have to do?).  A few days later accused husband called to tell her that he had remarried a woman who already had a child. The Complainant’s husband has remarried without divorcing her. Also at that time her husband also told her “tu flat ka paper de mujhe, tab hi main tujhe azadi donga mujhe,  tu mere bete se door rahana, wo flat muje mere bachhe ke liye chahiye”. (You handover to my the papers of the flat, then only I will give you freedon, and you be away from my son, I need that flat for my kid)

After hearing this the Complainant asked her husband why did he sold Thana house, as its ancestral property, after hearing this her husband started abusing her on phone. Accordingly, the complainant have come to file a complaint at the police station.

The Complainant’s statement was recorded in Marathi and it was explained to her in Hindi, also copy of the same handed over to her and she confirmed the same.
