The gist of the Complaint: Translated from Marathi to English on best effort basis.
The Complainant (sepoy no-111187), aged 32 years, resides at the above-mentioned address, who joined Mumbai Police department in 2011 as Sepoy, and is presently serving in Anti-terrorist squad at Samta Nagar Police Station since 2021.
The Complainant appeared at the police station for day duty on 24/01/2023. At about 8:30PM, while Police sub inspector Mr. Tanpure, Sepoy 092090/Bitke Hawaldar 00257/Bandre and the Complainant were patrolling in Police Station Precinct near Macchi market, near Savli Bar, Narsipada, Kadiwali (East), Mumbai, they saw a person was sitting down with a cigarette in his mouth, smoking some kind of drug with his cigarette.
After that, Police Sub-Inspector Tanpure asked the Hawaldar 00257/Bandre to go and get two PANCH and gave such information to day shift Police Inspector. After that, the Complainant came with two PANCH (Witness) in a short time. Police Sub-Inspector Tanpure introduced both the PANCH to our squad and explained the purpose of calling them to the said place, the PANCH agreed to appear as judges.
After keeping watch on him for some time, Police Sub-Inspector Tanpure ordered to take him into custody. According to Complainant and other Anti-terrorist squad officers detained him. There they found a cigarette-sized hash filled with half-burned stubs. After that, Sub-Inspector of Police Tanpure identified himself, the Panchas (Witnesses) and the police team to the accused and asked him to allow them to search him, but he refused.
Then, Police Sub-Inspector Tanpure asked accused about what he was doing at that place, and he said that he was consuming Ganja, a narcotic substance, by stuffing it into a cigarette butt. Then he was asked his name, age, and address, he gave it as detailed above.
When the accused was examined, his eyes appeared swollen and red due to drug consumption and his mouth smelled rough. Immediately, the accused was searched before the Pancha, a half-burnt cigarette-sized piece of Ganja in his hand was seized, extinguished and destroyed on the spot.
Then the accused was medically examined at Dr. Babasaheb Ambedkar, Kandivali West, Mumbai Hospital, the medical officer has given written report confirming that the accused had consumed Ganja, a narcotic drug.
Police Registered the case and took up the investigation. The case is being investigated by the Police officer namely Mr. Amol Tanpure.
The Complainant’s statement was recorded in Marathi and it was explained to him in Hindi and he confirmed the same.
