Mumbai, December 2, 2024 – Faujiya Shahrukh Sav has lodged a formal complaint with the Goregaon Police Station against her husband, Shoaib Khan, and several members of his family, alleging physical and mental abuse under section 498A, 323 of the Indian Penal Code.
Details of the Complaint: Faujiya, who married Shoaib Khan on December 24, 2021, reported that the initial three months of her marriage were peaceful while living with her in-laws in Mumbra, Thane. However, the situation deteriorated when her brother-in-law, Bahir, began to demean her for performing household chores. On March 20, 2022, when she sought her husband’s intervention, her sister-in-law Sara allegedly threatened her. Following this, when Faujiya confided in Shoaib again, he reportedly dismissed her claims as lies and physically assaulted her, also threatening divorce. Further allegations include ongoing harassment by her younger sister-in-law, Meenaj, for her household duties.
The situation escalated to the point where Faujiya was subjected to significant mental and physical stress, prompting her to move back to her mother’s home in October 2023. Since then, she has had no contact with her husband. Faujiya’s complaint specifically names Shoaib Khan, along with Shahir, Sara, and Meenaj, accusing them of physical assault and mental harassment. The FIR has been registered under Sections 498A (cruelty by husband or his relatives), 323 (voluntarily causing hurt), 504 (intentional insult with intent to provoke breach of the peace), and 506 (criminal intimidation), all read with Section 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code.
Business and Family Dynamics:
The family runs a business supplying Ambuja cement, managed by Faujiya and her husband Shoaib. The family setup includes four brothers-in-law and two sisters-in-law living together, which reportedly added complexity to the household dynamics.
Current Status: The police have initiated an investigation into the matter. No arrests have been reported at this time, but the accused have been named in the FIR. This case highlights the ongoing challenges faced by individuals in joint family settings, particularly concerning domestic harmony and individual rights. The Goregaon Police Station is expected to provide further updates as the investigation progresses. This case is one among many that reflect the need for addressing domestic abuse within the legal framework, ensuring that justice is served where familial bonds are strained beyond repair.
